Birth Control Patch Side Effect Lawsuit Filed by Hissey Kientz, LLP
Austin, TX (PRWeb) December 14, 2006 -- The law office of Hissey Kientz announced this week that it has filed suit against several defendants after a Florida woman suffered two pulmonary emboli just months after she began using the Ortho Evra birth control patch in 2002 (Case No. CGC-06-458689).
According to the lawsuit, doctors admitted the 27-year-old woman to the hospital in September 2002 and diagnosed her with a pulmonary embolism -- a severe and potentially fatal blood clot in the lung. The blood clot had originated in her leg (deep vein thrombosis) before moving to her lung. After being treated with Heparin and Coumadin therapy, she was discharged from the hospital but then suffered a second pulmonary embolism days later and returned to the emergency room, according to the lawsuit.
The lawsuit alleges that she continues to experience birth control patch side effects including continuous and heavy menstrual flow that is severe enough to cause her marked anemia (a deficiency of red blood cells), and she recently underwent surgery in an attempt to stop the bleeding.
The Ortho Evra birth control patch is applied to the skin and delivers up to 60% more estrogen and progestin than conventional oral contraceptives. In November 2005, the Food and Drug Administration warned consumers of the increased risk of blood clots associated with the Ortho Evra birth control patch: (http://www.fda.gov/bbs/topics/news/2005/NEW01262.html).
The Associated Press also reported in 2005 that users of the Ortho Evra birth control patch suffer blood clots and fatalities at a rate three times higher than those using traditional oral contraceptives.
According to the lawsuit, more than 4 million women have used the patch since 2002, but Ortho-McNeil did not notify them of the potential birth control patch side effects until months after the AP report in 2005. Ortho-McNeil has yet to recall Ortho Evra.
The lawsuit alleges that Ortho-McNeil was fully aware of harmful side effects but failed to warn consumers.
